The relevant sections in the Companies (Amendment) Ordinance 2010 which tackle offending company names have already come into effect on 10 December 2010.

Under the new laws, the Registrar of Companies is empowered to, amongst others, change the name of a shadow company which is “too like” the name of an existing company on its own volition.

The Registrar is further empowered to change the name of a shadow company upon being served with a Court order restraining the shadow company from using an offending name.

Since the coming into effect of the new law, RBJL have successfully lodged complaints with the Registrar of Companies on behalf of internationally renowned brand owners and caused offending company names to be removed.
